Apercloud SL, as data controller, informs you that, in accordance with the provisions of Regulation (EU) 2016/679 of April 27 (GDPR) and L.O. 3/2018 of December 5 (LOPDGDD), we will process your data as reflected in this Privacy Policy.

2. Purpose of processing

Maintain a commercial relationship with the user and provide the main features of the application. The operations planned for processing are:

• Provide route tracking and recording services based on the device location.
• Sending commercial advertising communications by email, social networks, or any other electronic or physical means, present or future, that makes commercial communications possible.
• Process orders, requests, or any type of inquiry made by the user through any of the contact forms available.
• Conduct statistical studies to improve the user experience and quality of our Route Explorer application.

3. Location and Tracking Data

Route Explorer requires access to your device location data for proper functionality:

• Precise location: We access your exact location via GPS to record your routes, calculate distances, speeds, and show your position on the map.
• Background location: The app accesses location data even when closed or not in use, but only while the user keeps route recording active. This is essential to ensure that tracking is not interrupted when turning off the screen or switching apps.
• Data use: This data is used exclusively for app features and is not shared with third parties for advertising purposes.

4. Legal basis of processing

Processing is based on the user consent by checking the acceptance box in our contact forms, as well as the legitimate interest of the Controller in maintaining the commercial and technical relationship necessary for the use of the application.

5. Data retention

Data will be kept for as long as necessary to maintain the purpose of processing. When no longer required, it will be deleted with appropriate security measures to ensure pseudonymization or total destruction.

6. User rights

The user has the right to:

• Right to withdraw consent at any time.
• Right of access, rectification, portability, and deletion of their data, and to restrict or object to its processing.
• Right to lodge a complaint with the supervisory authority (AEPD) if they consider the processing does not comply with current regulations.
